Welcome to McChat. These terms and conditions apply to your membership and use of the McChat site (currently located at mcchat.co.uk) (the “Site”).

McDonald's Restaurants Limited, a company incorporated in England & Wales, company number 1002769, having its registered office at 11-59 High Road, East Finchley, London N2 8AW, and McDonald’s Restaurants of Ireland Limited, company number 127316, having its registered office at 7 Richview Office Park, Clonskeagh, Dublin 14 (together "McDonald's") have established the Site in order to engage with customers for research purposes. Your access to and use of the Site is subject to these Terms of Use. By accessing and browsing the Site you accept these Terms of Use. If you do not agree to these Terms of Use, you should not use this Site.

Your use of and authorisation to access this Site (and the materials and content available via this Site) is a privilege and not a right and is subject to your compliance with these Terms of Use.

1. The right to access the Site is personal to the individual to whom McDonald’s has issued a username for that purpose, following the completion by that individual of a registration survey and subsequent creation of a password for the Site. The Site may not be used by you for any purpose that is not authorised by McDonald’s. Employees of McDonald’s, its franchisees, PA Consulting Limited, STRAT7 Researchbods, a division of STRAT7 Limited and each of their respective subsidiaries and affiliates are not permitted to use or access the Site except as required by McDonald’s for administrative purposes.

2. It is your responsibility to maintain the confidentiality of your password and you are responsible for all activity that occurs under your username and password. Therefore, you must not disclose either your username or password to others or do anything which would assist anyone who is not a registered user to gain access to any area of the Site. You must not seek to pass yourself off as another user. You understand that you are fully responsible for all activities connected to your username including any data, content and/or materials you access, submit, receive or transmit via this Site. We recommend that you regularly update your password and that you ensure you use a strong password with a combination of letters, numbers and symbols.

3. We reserve the right to suspend and/or terminate your access to the Site for any reason, including without limitation any violation of these Terms of Use. We also reserve the right to change, suspend, or discontinue any aspect of the Site at any time, including the availability of any Site content, without prior notice.

4. If, following an investigation, there is evidence of misuse and/or abuse of this Site, we reserve the right to cancel your account and to ban you from registering for a new account if the security of your account is compromised in any way and for any reason.

5. You may terminate your membership of the Site at any time by going to your ‘Profile’ page and clicking on the ‘close account’ option, or by contacting us at support@mccchat.co.uk.

6. You agree that you will treat all information, specifications and other data on the Site as confidential and you will not, at any time disclose the same whether directly or indirectly, to any third party without the prior written consent of McDonald’s.

7. To avoid any doubt, information found on this Site is for general guidance only and should not be specifically relied on by any user without taking appropriate professional advice.

8. You may download one copy of the materials contained in or displayed on the Site and print off pages of the Site for non-commercial personal use only provided that (a) you do not remove or alter any copyright and other proprietary notices contained on the materials and (b) all use is for lawful purposes only. Neither the content of the Site nor any part of it may be distributed, reproduced, modified, transmitted, reused, re-posted or used for public or commercial purposes without McDonald's prior written permission. If you print off, copy or download any part of our site in breach of these Terms of Use, we reserve the right to immediately restrict your right to use the Site and require, at our option, that you return or destroy any copies of the materials you have made.

9. The Site and the content, functionality and design of the Site is protected in the UK, Ireland and elsewhere in the world by copyright, trade marks, design rights and other intellectual property rights owned by McDonald’s or used by us under licence from a third party or a member of the McDonald's Family; by this expression, we mean McDonald's Corporation and each of its subsidiaries, together with their respective franchisees and certain selected companies (which are either our partners who perform a function such as prize-provision within our promotions and offers, or agencies and suppliers whom we have retained to assist us to more effectively fulfil orders, manage and conduct promotions and offers, provide technical assistance and support and perform other functions to support our marketing activities and the Site). None of the Site, the Site content, the Site functionality or the Site design, nor any part of any of each, may be used in any manner whatsoever, except either as provided for in these Terms of Use or in the text on the Site.

10. McDonald's will not be liable for any damages or injury howsoever caused including, but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure on the Site.

11. Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, ideas, graphics or the like is, and will be treated as, non-confidential and non-proprietary but we shall comply with our privacy statement in respect of any personal information we receive from you. You understand that by submitting any information to McDonald’s via e-mail or on the Site, you grant McDonald's a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, sublicense to others, modify, translate, prepare derivative works of, publicly display, and publicly perform the submissions, including to use them for any commercial or other purpose whatsoever without approval from or compensation to you or any other person. McDonald’s will not be required to treat any submissions as confidential.

12. You agree that you will abide by the terms included in the ”What’s in it for me” section located on the Site and in conjunction with this you must not post or transmit any unlawful, fraudulent, libellous, defamatory, obscene, pornographic, sexually explicit, profane, threatening, abusive, violent, discriminatory, hateful, offensive, harassing, or otherwise objectionable content of any kind, including, but not limited to, any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any relevant law when sending, posting, sharing or contributing information to McChat. Furthermore, you must not post or transmit any information, including pictures, which is invasive of another person’s privacy or otherwise violates or infringes another person’s rights (including intellectual property rights such as copyright).

13. McDonald’s does not review submissions before they are posted on the Site and therefore in the unlikely event that another user posts something on the site that violates these rules or which you find offensive please report this to McDonald’s immediately and confidentially at support@mcchat.co.uk (please give as much information as possible to allow McDonald’s to make an informed decision on the abuse). McDonald’s relies on the users to help keep the Site clean and friendly. If you report an abuse using this forum, this will flag the post for McDonald’s who will review it. If McDonald’s considers the submission to be a violation of the Terms of Use then the submission will be removed and McDonald’s will follow up with the member accordingly. If it is not deemed to be a violation the submission will remain on the site.

14. McDonald's reserves the right to restrict submissions to those that are directly related to the specific subject matter of the Site. McDonald's may, but does not have the obligation to, monitor submissions to ensure that users adhere to these Terms of Use and all applicable policies. McDonald's reserves the right to reject, refuse to post or remove any submission that it considers to violate these Terms of Use or any other policies or for any other reason as determined in its sole discretion. McDonald's shall also have the right to edit, revise or modify any submissions as determined in its sole discretion. McDonald's may, but will not always, reply to submissions posted on this Site. McDonald's has not reviewed any websites linked to the Site and is not responsible for and does not endorse the content of any off-site pages. If you access any off-site pages or other sites, this is entirely at your own risk and we recommend that you read the website terms and conditions and privacy statement of any such site.

15. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.

16. You must treat your account log in information as confidential and you must not disclose it to any third party. We have the right to disable any user access to the website, whether chosen by you or allocated by us, at any time, if in our reasonav support@mccchat.co.uk.

17. On termination of these Terms of Use or of your permission to use the Site, all rights granted to you under these terms shall cease; however, these terms will continue to apply to your prior use of the Site and anything relating to or arising from such use. Upon termination, all rights of McDonald’s, including all intellectual property rights, proprietary rights, and licenses in these terms shall survive, as well as all restrictions on use, all limitations on liability and disclaimers.

18. Unless otherwise stated or the context requires otherwise the Site relates to the business of McDonald's in the United Kingdom and Ireland only.

20. Any exclusion or restriction of liability contained in these Terms of Use shall apply only to the fullest extent permitted by the laws of England.

21. You are responsible for compliance with applicable local laws relating to the use of or otherwise connected with the Site. To the extent that this Site or any activity contemplated by it would infringe any law of a jurisdiction other than England, then you are prohibited from accessing this Site or attempting to carry on any such offending activity and this provision shall override all other provisions of these Terms of Use.

22. Any use of the Site shall be subject to the laws of England and any dispute arising from such use or otherwise in connection with the Site shall be subject to the exclusive jurisdiction of the courts of England.

23. All information given in this site applies to the UK and Ireland only, but is subject to change without notice. The information is not intended to give rise to any legally binding obligation and may not be considered to make any representation on any matter.

24. McDonald’s reserves the right to change, revise or amend these Terms and Conditions at any time without prior notice. If we do this, we will post the updated Terms of Use on this page and indicate at the bottom the date these Terms of Use were last updated. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use. You should review these Terms and Conditions regularly to stay informed of any changes which may affect you
